By accessing or using the website of Optimize Employer Health (“Company,” “we,” “us,” or “our”), including submitting information through our online intake or enrollment forms or communicating with us via text message, you agree to be bound by these Terms & Conditions and our Privacy Policy. By using our website, you also acknowledge receipt of our Privacy Policy.

If you do not agree, please do not use our website or services.

1. Services

Optimize Employer Health is a virtual, telehealth-only service. All clinical services — screening, evaluation, prescribing decisions, consultations, and follow-up — are delivered remotely by licensed clinicians through secure video or telephone visits and secure messaging. We do not operate a clinic, med spa, or any in-person location for patient visits, and no in-person examination is offered or required as part of these programs. Medications prescribed through the service are dispensed and shipped by a licensed compounding pharmacy directly to you.

We reserve the right to modify, suspend, or discontinue any part of our services at any time. Where practicable, we will endeavor to provide reasonable advance notice of material changes to our services.

2. No Emergency Services; Scope of Telehealth

Telehealth has limitations. A remote visit may not be appropriate for every condition, and your clinician may determine that your needs cannot be safely addressed virtually. In that case, you may be declined for a program and advised to seek care from an in-person provider of your choosing.

Our service is not for emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency department. We do not provide urgent or after-hours care.

3. Eligibility

You must be at least 18 years old and physically located in a state where our clinicians are licensed to use our website, submit personal information, or receive services. By using our website, you represent that you meet these requirements. If you have reason to believe a minor has submitted personal information through our website, please contact us immediately at info@optimizeemployerhealth.com so we may delete that information.

4. User Responsibilities

When using our website or services, you agree to:

  • Provide accurate and complete information, including a full and honest medical history, medication list, and allergy history in your intake
  • Promptly update us if your health status, medications, or pregnancy status changes
  • Use our website only for lawful purposes
  • Not misuse, disrupt, or interfere with our website or systems
  • Not attempt unauthorized access to any part of our systems

Incomplete or inaccurate health information can lead to unsafe treatment decisions. Your clinician relies on what you report during your virtual screening and consults.

5. SMS Messaging Terms

By providing your mobile phone number through our website forms, scheduling tools, chat features, or other communication channels, you expressly consent to receive text messages from Optimize Employer Health. This consent is obtained at the point of data collection through a clear and conspicuous opt-in disclosure as required by the Telephone Consumer Protection Act (TCPA) and applicable FCC regulations. Your consent applies only to Optimize Employer Health and is not shared with or transferred to any third party.

These messages may include:

  • Virtual visit and telehealth appointment reminders
  • Service updates
  • Order and shipment confirmations
  • Customer service responses
  • Promotional or marketing messages (if applicable)

Message Frequency. Message frequency may vary depending on your interaction with us.

Message & Data Rates. Message and data rates may apply according to your mobile carrier plan.

Opt-Out Instructions. You may opt out of receiving text messages at any time by replying:

  • STOP – to unsubscribe
  • CANCEL or UNSUBSCRIBE – also accepted to unsubscribe
  • HELP – for assistance

Opt-out requests will be processed within 10 business days. You may also contact us at info@optimizeemployerhealth.com for support.

Consent Not Required for Purchase. Your consent to receive text messages is not a condition of purchasing any goods or services.

Carriers. Mobile carriers are not liable for delayed or undelivered messages.

6. Privacy

We respect your privacy. Any personal information collected through our website or SMS communications is handled in accordance with our Privacy Policy and, where it constitutes protected health information, our HIPAA Notice of Privacy Practices.

We do not sell or share your phone number with third parties for their marketing purposes.

Personal information collected through our website and SMS channels is retained only as long as necessary to fulfill the purposes for which it was collected, or as required by applicable law. California residents and users in other applicable jurisdictions have the right to request access to, correction of, or deletion of their personal data by contacting us at info@optimizeemployerhealth.com. In the event of a data breach affecting your personal information, we will notify you as required by applicable law.

7. Payments & Billing

If you purchase services or products from us:

  • All prices are subject to change without notice.
  • Payment is due at the time of purchase unless otherwise agreed.
  • The one-time sign-up fee is non-refundable.
  • Program subscriptions renew automatically until cancelled in accordance with our Cancellation & Refund Policy.

Full billing, program-change, and cancellation terms are set out in our Cancellation & Refund Policy, which forms part of these Terms.

8. Intellectual Property

All website content, including text, graphics, logos, images, and design elements, is the property of Optimize Employer Health and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use our content without written permission.

9. Disclaimer of Warranties

Our website and services are provided “as is” and “as available” without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted, secure, or error-free operation of our website or services, and we do not guarantee any particular clinical outcome or result.

10. Limitation of Liability

To the fullest extent permitted by law, Optimize Employer Health shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of, or inability to use, our website or services, even if we have been advised of the possibility of such damages.

Our total cumulative liability for any claim arising out of or related to these Terms or your use of our services shall not exceed the greater of: (A) the total amount paid by you to Optimize Employer Health in the six (6) months preceding the claim, or (B) one hundred dollars ($100.00).

11. Third-Party Links and Services

Our website may contain links to third-party websites and services, including scheduling, payment, and pharmacy partners. We are not responsible for the content or practices of those websites.

12. Dispute Resolution; Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. Any dispute, claim, or controversy arising out of or relating to these Terms & Conditions or your use of our website or services shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may seek injunctive or other equitable relief in court for infringement of intellectual property rights.

You and Optimize Employer Health each waive the right to a jury trial and the right to participate in a class action or class arbitration.

Arbitration shall take place in Tampa, Florida, and may be conducted remotely where the arbitrator permits. Judgment on the award may be entered in any court of competent jurisdiction.

13. Termination

We reserve the right to suspend or terminate access to our website or services at our discretion if these Terms are violated, or where continued treatment is not clinically appropriate.

14. Governing Law

These Terms & Conditions are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes not subject to the arbitration clause above shall be resolved exclusively in the state or federal courts located in Tampa, Florida, and you consent to the personal jurisdiction of such courts.

15. Changes to These Terms

We may update these Terms & Conditions at any time. For material changes, we will provide at least thirty (30) days’ prior notice by email (to the address associated with your account, if any) or by posting a prominent notice on our website. Changes will be reflected by updating the “Effective Date” above. Your continued use of our website after updates constitutes acceptance of the revised terms.

Mobile Terms of Service

Messages related to your account, orders, services, virtual visit reminders, marketing and promotional messages may be received. Frequency may vary.

You can cancel the SMS service at any time by texting “STOP.” After you send “STOP,” we will confirm your unsubscribe via SMS. After this, you will no longer receive messages from us. If you would like to opt back in, you may sign up again as you did previously.

Carriers are not liable for delayed or undelivered messages.

Message and data rates may apply for any messages sent to you from us and from you to us. For questions about your text or data plan, please contact your wireless provider.
